LEGAZPI CITY, April 9 (PNA) -- Some 204 employees, who had complained of labor violations and won the case, received a total of Php7.6 million worth of claims from their employers.
Lawyer Ma. Karina Perida-Trayvilla, newly appointed Department of Labor and Employment (DOLE) Bicol regional director, said the claims came from the General Labor Standards (GLS) cases successfully “settled” by the office in the first quarter of this year alone.
“It’s a settlement fee to the workers after we (DOLE) found labor violations from their (workers) companies or establishments,” Trayvilla added.
The Php7.6-million money claims came from the 34 GLS cases settled, out of the 56 handled by DOLE Bicol in the entire region.
A GLS case ripens if a DOLE Labor Laws Compliance Officer (LLCO) finds a labor violation after an on-site assessment in a company.
Trayvilla said violations might vary from the most common violation of underpayment of wages, non-payment of overtime pay, non-payment of holiday pay or premium pay and other wage-related benefits up to rare cases of leave violations such as service incentive leave.
“Once our LLCO finds a labor violation, the company is given 10 days to present proof or correct said violations. If they (company) could not do it then it will ripen into a GLS case. On a GLS case, the employer and employee are called and correction or payment of said violation is effected," she explained.
However, the DOLE Bicol chief said, the “settlement fee” might still be negotiated by the employer and the employee but if a settlement was not possible then the DOLE would issue a compliance order.
It is from these settlement agreements and compliance orders where the Php7.6 million money claims came from.
The amount of settlements or compliance orders varies from one employer to another depending upon the labor violations committed, Trayvilla said.
“If you look at it, this figure gives us a 60-percent accomplishment rate in terms of cases settled. In GLS that’s a big accomplishment,” the labor regional official claimed.(PNA) RMA/FGS/CA/CBD/PJN
